About Our Products
We carry high end cosmetics and skincare that are normally sold in high end department stores.
ALL of our items are BRAND NEW and AUTHENTIC. ALWAYS! We will NEVER sell any USED item.
We are NOT affiliated in any way with any of the companies that make the products that we carry.
Many of our items are unboxed. Because of this the outside of items may be scratched, tops could be cracked or even lettering fading over from rubbing against other items. Each of our items is thoroughly inspected when we receive our shipments in and noted for any defects. Any noticeable defects in the packaging itself is listed in the auction. Item is then inspected again before it is shipped out to you. Product itself will be completely perfect or we will not ship it. I would rather refund you right away than send you a product that is not what it should be. We try very hard to make sure your experience at Bela’s Boutique is smooth and enjoyable! We want you to come back!!!
TESTER, DEMONSTRATION & NOT FOR RETAIL SALE
I sometimes get GREAT deals on items that are marked TESTER, DEMONSTRATION & NOT FOR RETAIL SALE. They are still brand new, full size and the exact same product. They might be in a slightly different packaging or they may just have a sticker stuck on them. It all depends on the brands. But when I get a great deal…then you get a great deal!!!
GIFT WITH PURCHASE (GWP)
GWP (Gift with Purchase) I don’t carry many of these usually, but I do get them from time to time. These are basically purse size items or full size lipsticks just in different packaging. They are usually used for promotions. We always list the size on the listing usually in ounces and MLs.
When these phrases are used: TESTER, DEMONSTRATION & NOT FOR RETAIL SALE they are pertaining to the retail store environment. It is completely fine for them to be sold in this venue.
*We reserve the right to cancel any auction or refund any purchase made in our store. Since we carry such a wide variety of items along with a huge amount of items it is hard for us to check each product daily. We check everything when we receive a shipment and again before we send the items out to our customers. So there are rare instances when we are going to pack up items and we are checking them and we feel they are just not up to our standards. In this instance we would refund you immediately if we do not have a duplicate item. Please understand why we do this. We would rather refund you and maybe even have you buy it from someone else rather than send you an inferior product.
Out of Stock Items
We try very hard to make sure we have the merchandise that matches the listings. However, it seems that items get re-listed sometimes. This usually happens a couple times a week someone will purchase an item that we haven’t had in forever and it is a shock to us because we know that we are out of stock on that item and can’t figure out why it was even listed! In any case, when we are out of stock on an item we will refund you right away and send you an email to let you know that we are out of that particular item.
Refunds & Exchanges.
Since we are not a department store we do not have the luxury of having tester displays out for our customers to test and look at the exact colors. We do the best we can by taking our own pictures. As our policy states all sales are final. This is because of the nature of the items that we sell. We do not exchange or refund if you do not like the color, the scent or whatever of an item.

If by chance there is a problem with an item, it must be sent back to us in order for you to receive a store credit. We do NOT refund or credit any shipping charges at all to return the product. We will not issue any store credit until we receive the item. The item must be returned to us in the exact same manner as it was shipped to you, meaning it can not have been used or tested. If we determine that it was used or tested no refund will be made.
Payment Options
Paypal is the preferred method of payment at this time. Payment is expected within three days of purchase. Since we do combine shipping, please let us know if you are bidding on any other auctions so that we know it will possibly be longer than three days. Items won within 3 days of each other can be combined on one invoice for shipping discount.
We are very sorry but Paypal is the only form of payment that we now take. Ebay's new policy is that we can only accept Paypal and can no longer accept any "Paper" form of payment : money order, cashier's check, personal check. You can pay via Paypal with your bank account or a credit card securely without exposing your financial information!
We understand that problems do come up and that sometimes it may take longer than three days for you to send payment. All that we ask is that all buyers communicate with us. Please let us know if there is an issue that will delay payment. This will help to avoid us filing a dispute and the buyer being issued a non paying bidding strike.
If payment isn’t made within 3 days we will send out a payment reminder. If there is no response, on the 7th day we will file a non paying bidder claim, the item will be re-listed and the buyer will be placed on our blocked list.
SHIPPING
We ship world wide with the exception of Germany. Due to German laws we can no longer ship to that country. All items are shipped within 5 days of payment.
We use the shipping calculator to insure the best shipping prices to your zip code or country.
Please wait for an invoice to ensure the proper shipping totals.
PACKAGING
All of our items are securely packed with bubble wrap and we use bubble mailers as well.
COMBINED SHIPPING
We combine shipping! We will combine shipping with items that are purchased with in 3 day and are on the same invoice.
US & CANADA
Combined shipping is as follows: Full price for heaviest item. Each additional item will now be ONLY $.75 each (Old price was $1.00 per additional item!) This price includes all items except for Erno Laszlo Pro Size products and Wholesale lots. Neither of these can be combined for shipping discounts.
CANADA: Canada is kind of domestic and international. We have changed our policy to include the lower per additional items that are shipped to Canada because it is much cheaper to ship to Canada than it is Europe.
INTERNATIONAL SHIPPING
Combined shipping for international packages is as follows: Full price for the heaviest item. Each additional item will now only be $1.75 each (Old price was $2.50 each)! This price includes all items except for Erno Laszlo Pro Size products and Wholesale Lots. Neither of these can be combined for shipping discounts.
International packages that amount to over $150.00 will be required to be shipped registered mail along with being insured. (Registered mail $10.15 plus insurance)
OTHER INTERNATIONAL SHIPPING POLICIES
Customs Forms: We do NOT mark items as GIFTS on our customs forms. We do NOT lower the price of the items on the customs forms. Both of these constitute mail fraud per Title 18 U.S.C 1001 which summarized says : Furnishing false information on the customs form may result in a fine of not more than $10,000 or imprisonment of not more than 5 years or both. Information on the form will be used to satisfy reporting requirements for customs purposes.
Customs Charges: We are not responsible for paying any custom charges that you may incur when the item is delivered to your country. Nor are we responsible for any possible quarantine or confiscation. If the item is not picked up at the post office and the customs charges are not paid the post office of the country in question will send the items back to the sender. Because we have sent them in a timely fashion but they were not picked up by the buyer, we will not refund the money for the products upon return. If the buyer would like the items sent again, the buyer will be responsible for repaying the shipping charges to have the items resent.

REFUNDS & RETURNS
We do not issue refunds. We only issue store credits in special circumstances and the item must be returned within 7 days. We do NOT however refund for any shipping costs. Because of the nature of our products we are unable to accept returns for any other reasons.
We are not affiliated in any way with any of the companies of the products we carry. All products are at a buy at your own risk, meaning the buyer is responsible for any reactions from misuse, unintended use and any sort of reaction due to ingredients, skin sensitivity etc. We are also not responsible for any claims that the manufacturer makes as to the results that you may achieve with any product.
FEEDBACK
Feedback will be left for every transaction. We hope that if you like the service and your product that you will leave us positive feedback. Please inform us of any problems before leaving negative or neutral feedback. As you can see we take customer service very seriously and like to work with our customers to ensure a pleasant experience. We can’t solve a problem if we haven’t been notified of it.
Ebay’s new policy states that we can no longer give buyers negative or neutral feedback. It also states that buyers now have to wait for three days before leaving negative or neutral feedback. This is to encourage communication between the buyer and seller so that problems can be cleared up with out disputes and claims. Please contact us with any problems or concerns before leaving feedback to ensure we can take care of the problem. Please do not assume just because another seller wouldn’t work with you that we wouldn’t. We have a good feedback score for a reason. We care about our customers and customer service is our top priority.
VERO
NOTICE TO THE EBAY VERO PROGRAM: This auction consists of 100% original description and merchandise. All pictures have been taken with our own personal digital camera and/or available stocks. Proof can be provided if necessary.
It is our understanding that if, for example you are selling a Lancome or Dior Mascara, you can say, "This is a Lancome or Dior mascara" without infringing on the trademark.
International law is consistent on these issues. All pictures are taken with our camera and the descriptions are composed by us on our computer.
The Lanham Act also specifically recognizes the "fair use" of a company's trademark. The Fair Use Doctrine grants the use of a trademark under certain conditions. Copyright laws: “Copyright law, like trademark law, grants a lot of exclusive rights to the holder of the copyright. It also states specific exceptions. The First Sale Doctrine is an important part of trademark law. Without it, owning something would be VERY complicated. The First Sale Doctrine says that once the owner of a copyrighted item sells it, or gives it away, the owner can no longer control what is done with the item. If that were not the case, you could not repaint your car, have a garage sale to get rid of junk, or donate that old computer to the charity. The First Sale Doctrine prevents the copyright owner from interfering with your use, alteration, and subsequent disposal of something you bought or received as a gift.
Suppose you purchased a coloring book manufactured by Disney and your child colored a picture making the Lion King purple. Should Disney have the right to have you arrested because your child didn't use the correct colors? No. They lost control of that coloring book when you bought it. “In short, fair use permits others to use a protected mark to describe aspects of their own goods, provided the use is in good faith and not as a mark”. See 15 U.S.C. § 1115(b)(4) . That is precisely the case here. The "offending" use described is merely fair use to describe the product(s) offered for sale. The fair use doctrine permits use of a protected mark by others to describe certain aspects of the user's own goods. See Car Freshener Corp. v. S.C. Johnson & Son, Inc. 70 F.3d 267, 270 (2d Cir. 1995).
If in any way this or any other auction listed in our store is wrongfully ended through a VERO member or by EBay Trust and Safety, please note the following – Bela’s Boutique belas.boutique03 will seek financial compensation from the VERO member or from EBay for: Tortuous Business Interference and Negligent Representation, Fraudulent Representation, Outrageous Conduct based on the “first sale doctrine” and the “fair use” of trademarks.
