We are a retail store, a rally store, and have a company web store called Gearuphelmets.com.  We love selling on EBAY.  Ebay has it’s own policies and procedures we have to maintain in order to remain in compliance.  Below are these policies.  We and our customers have to abide by these so make sure you read through them before making your purchase: 

Ebay Terms and Conditions: (Your purchase is a complete agreement to all of these terms)
Ask all questions before you buy. All items are sold as pictured-nothing extra. Description may indicate any changes other than how the item is pictured. We always try to use the most updated pictures when available. Due to ongoing product improvements and model year changes the item you receive may look slightly different than pictured. It may be an upgraded version.  Occasionally we run out of certain items and may need to offer you a substitution, possible upgrade, or a refund. Please check your email often.

Email Problems:

AOL, Hotmail, Yahoo, etc. and Norton users:
Many times your spam blockers prevent our e-mail replies from getting to you. If you don’t get a response in 12 hours (excluding weekends) please call us at 931-403-3872, contact us through ebay, or use a different email account with which to contact us.

Payments Accepted:
WE  SELL TO AND TAKE PAYMENTS TO OVER 190 COUNTRIES
We accept credit card payments from Master Card, Visa and Discover by calling (931) 403-3872.  We can only ship to the credit card statement address. (if needed shipped elsewhere, please call us directly and we’ll make other arrangements)  We accept Cashiers Checks, Money Orders, but sorry, no personal checks. We accept Pay Pal payments (paypal@gearuphelmets.com) but we have to ship to the address that comes in with the payment and is registered with Pay Pal. We cannot change the ship to address. (please call if an alternate ship to address is required)  
If Pay Pal says your payment is ineligible for seller protection then you will have to use a different form of payment. All payments must be in US dollars.

Shipping Rates:
All rates on eBay are calculated for shipping in the contiguous US states. International shipping is usually 2-3 times higher, or more when available. International buyers, we will also need a phone number with your payment. Please contact us at 931-403-3872 for exact freight rates for overseas orders.

Payment Clearing & Shipping: We normally ship out within 1 to 3 business days if you make an instant payment. If paying by Pay Pal in the USA we can only ship to your confirmed address. If you send a money order or make an e check payment, we cannot send your item(s) until the check clears our bank or pay pal. Checks normally take 5-7 business days to clear.  We ship M-F only (excluding holidays).  USPS priority mail (normally 2-3day service in USA) is available for an additional $4.00 if the item is less than 5 lbs. Call for express mail quotes. WE RECOMMEND YOU PAY FOR PRIORITY MAIL OR EXPRESS MAIL IF YOU NEED YOUR ITEMS IN A HURRY.  Alaska and Hawaii sometimes cost a few dollars more. We recommend priority mail and some packages due to size and weight can only go priority mail.. Faster shipping is available if you call before payment.

ALL INTERNATIONAL BUYERS –  Shipping & Handling fees do NOT INCLUDE ANY DUTIES, TAXES, OR BROKERAGE FEES. We do not know these international fees, as it varies from country to country, item to item, shipping method, etc. & continuously changes. You will be 100% responsible for any additional fees. As a business we CAN NOT ship items as GIFTS, so please don’t ask.

Ship-to- addresses
Make sure your address is current before you make a payment. No address changes or requests for us to send packages to any other address, is against Pay Pal policy. If you pay by credit card we have to ship to the billing address. Due to fraud we just can't send packages anywhere else unless you call us directly at
(931) 403-3872

Tracking-
Most of the services we use will send tracking info to you. Some services like 1st class and Priority mail do not have tracking but will have delivery confirmation. UPS sends notices through Quantum View. USPS only has tracking on express mail. Please keep in mind that tracking an item does not get it there any faster and we always send items out as soon as we can (normally within three business days) unless it was a special order. If the package appears to be lost after allowing reasonable delivery time according to the shipping service you chose and paid for we will certainly track it down if we can. International buyers-please allow 2-4 weeks for delivery. Many spam blockers kick out the tracking notifications. Please review your email folders or one of the sites above for shipping details and be patient as all shipping services may run a day or two late during the holidays. Chasing a tracking or conformation number does not speed up the delivery. Please be patient and allow some time for delivery.

Shipping Insurance
Insurance or signature confirmation must be requested and purchased by the buyer for all items they wish to have insured.  We are not responsible for lost or stolen packages.

Combined Shipping
Combined Shipping and Handling (S&H) costs are usually calculated by weight, dimension, and zip code. If your items do not auto-combine, please contact us for appropriate combined shipping costs on your items.. Some items cannot be packaged together due to physical size or weight. For big orders or any questions please call us at (931) 403-3872. You can always request a total during check out when you are done shopping on Ebay. International shipping is based on weight and the country it is going to. Please contact us for a rate.

Exchanges
All exchanges must be made with 14 days of purchase. A return authorization number must be obtained and clearly labeled on the outside or inside of the box before returning. Call us at (931) 403-3972 for a return authorization number. All merchandise must still be in new condition with all of the original packaging, tags attached and undamaged. Buyers are responsible for all shipping costs to and from. No exchanges on closeout or special order merchandise.

 Exchanges being made due to our error:  We will refund the standard shipping fee from the original carrier service only upon the return of the merchandise. If you return a package using express mail or a different currier you will not be reimbursed for the extra expense. The shipping services we use to return the merchandise back to you will be at our expense. In the event there is a manufacturer defect, mix up or warranty issue beyond our control this may need to be handled by the manufacturer and you will be subject to their return/exchange policies.
 
Returns
All returns must be made with 14 days of purchase.. A return authorization number must be obtained and clearly marked on the outside or inside of the box before returning. No returns on closeout items or special ordered merchandise. No returns on any used or damaged merchandise or packaging. Do to the nature of electronics and the way they are sometimes handled or misused we will not accept any returns on electronics. Scala Rider will warranty all units within their warranty period with a copy of your receipt. No returns on helmets, shields, or vehicle windshields if they are missing the protective film or have been used.  All merchandise eligible for return must still be in new condition with all of the original packaging, tags attached. All returns are subject to a 15% restocking fee and no refunds on shipping or pay pal fees.

Cancelled Orders

Ebay does not have a cancel option. All listings cost EBAY sellers money up front when they list it and then a final value fee when the item listed is purchased. We pay thousands of dollars a month in Ebay fees before it ever sells. Non paying bidder disputes will automatically be filed with Ebay so we can get our fees back. We are really easy to work with. Need a different size or color or maybe you found a different item you like better? Warranty
Gearuphelmets.com does not imply any warranty of its own on merchandise sold. Most manufacturers have their own warranty policies in effect and reserve the right to repair or replace any defectives. We will gladly assist you when issues arise on the products we sold which may involve sending your items back to us or the Manuf. for repair or replacement.

Feedback & 5 Star Rating
Its really very simple and your bid or purchase is an agreement to these terms. Feedback has been and always will be voluntary, some do it and some don’t. For those who are interested in feedback and leave us positive feedback-we will return the favor
.

Our customers should never have a reason to leave us neutral or negative feedback as we offer RETURNS, EXCHANGES, OR items are sold AS IS or on CLOSEOUT (non returnable) and everything is clearly stated in our listings.  We should be judged as a seller only and not a manufacturer or shipping carrier or their prices or delivery times. Sorry, but if a neutral or negative feedback is left without contacting us first for a resolution the sale is final. At that point we will make no attempt to resolve any issue and you will be placed on our blocked bidder list to prevent future purchases.

Policy Changes
We reserve the right to make any and all necessary changes to our policies at any time to comply with federal and local laws, Ebay rules and new company policies.

Sales Tax
Tennessee residents are required to pay 9.75%% sales tax.

 
Free Shipping offers

Any free shipping offers are for online purchasing only in the 48 contiguous USA. It is a one time offer on new purchases for specific items and cannot always be combined with other items to receive them with free shipping as well. We ship using standard service from UPS or USPS at our discretion. If you need faster service please call us to place the order.

Online Risks
There is a small amount of risk involved with online or over the phone purchasing.  First off, buy from a company with a good reputation and great feedback such as ours. Be a little flexible; you can't tell by a picture if the item will fit you we can't see you to advise.  Also, colors do not appear the same on every computer display making it sometimes difficult to match other items. Just ask us and we will try to help in any way we can. Allow time for shipping. You may not receive you item as soon as you would like with standard shipping. If you’re in a hurry, need it for a trip or event and willing to pay extra for a faster shipping service, then let us know right away so we can give you all the shipping options. Most of our items can be sent priority mail (2-3 days) for an additional $4.00 if under 5lbs.
