| The following Terms and Conditions (“Terms and Conditions”) shall apply to a discounted golf round certificate (“Certificate”) issued by Maui Discount Golf Rounds (“Maui Discount Golf Rounds”) to you (“You”). You must be at least 18 years of age and able to enter into binding contracts or you shall be deemed to have the authority to act on behalf of and to bind the person named on the Certificate to these Terms and Conditions. Acceptance or usage of a Certificate shall be deemed as the acceptance by You and the person named on the Certificate to these Terms and Conditions.
1. A Certificate, when issued by Maui Discount Golf Rounds, shall entitle the person named on the Certificate, subject to these Terms and Conditions, to use the discounted golf round described on the Certificate.
2. Each courses’ certificates have different expiration dates. The following is a list of the expiration dates for the different courses’ certificates: Kaanapali Kai Golf Course (3/31/2009); Royal Kaanapali Golf Course (3/31/2009); The Dunes at Maui Lani (6 months from the date of issue); Pukalani Country Club (6/2008); elleair Maui Golf Club (1/31/09); and Wailea Old Blue (none). A Certificate may not be redeemed outside of the dates indicated on the Certificate. Pukalani Country Club does not accept certificates for use on holidays.
3. Gratuities and incidental charges, such as equipment (clubs and shoes) rentals are not included.
4. A Certificate is valid for redemption only by the person named on the Certificate. A Certificate has no cash value and cannot be assigned, or transferred, in whole or in part.
5. Refunds are available. A Certificate is like cash – a destroyed, lost or stolen Certificate cannot be reprinted or reissued. A Certificate may be redeemed only once at the golf course. A Certificate should be kept in a safe place, and should not be exposed to sunlight, heat, cold or liquids.
6. Maui Discount Golf Rounds is not responsible for any technical, printing, typographical or other errors associated with the description, depiction, availability, or pricing of a discounted golf round. Availability and price quotations for a discounted golf round are subject to change without notice until a Certificate has been issued. Prices listed on the Certificate are per person, unless otherwise specified.
7. When Maui Discount Golf Rounds is informed in advance of a significant change to the availability of a discounted golf round, Maui Discount Golf Rounds will use reasonable efforts to notify You. In the event a discounted golf round is canceled, rescheduled or postponed by the golf course, You should notify discountgolfrounds immediately (1-800-509-0370).
8. The golf course is an independent contractor of Maui Discount Golf Rounds. The golf course, and its owners, operators, contractors, and employees are not agents or legal representatives of Maui Discount Golf Rounds for any purpose and have no authority to act for, bind or commit discountgolfrounds. The golf course, and its owners, operators, contractors, and employees are solely responsible for the use and operation of the golf course, and all actions or events occurring at the golf course.
9. To the maximum extent permitted by law, Maui Discount Golf Rounds shall have no liability for any personal injury or death; lost, stolen, damaged or destroyed property; or other liability arising out of or in connection with the use and operation of the golf course, and all actions or events occurring at the golf course. |
