Use Of Real Estate Signs By Purchaser
1. By initiating a purchase or bid, Purchaser covenants and agrees that Purchaser is purchasing the sign(s) for Purchaser's own account for advertising property FOR SALE BY OWNER and further covenants and agrees that the sign(s) are not for resale or other use. Purchaser specifically agrees and understands that the word "posting" or "as posted on" and/or similar language on the sign(s) references eBay postings online which are sometimes referred to as "eBay listings," and that phrase "eBay listing" is an eBay community online usage only which refers to and means FOR SALE BY OWNER. Purchaser agrees and understands that eBay listings are not listings as that term is or may be defined by real estate law or agency law or other applicable law and that NO BROKERAGE OR AGENCY RELATIONSHIP OF ANY KIND is intended or formed by the sale of the signs, by posting on eBay or by the "eBay listing," or by the other acts of eBay, ONFIRE, or Purchaser.
2. By initiating a purchase or bid, Purchaser agrees to use the sign(s) solely for advertising of Purchaser's real property FOR SALE BY OWNER as currently posted on eBay and not for any other use. Real estate advertising includes real estate of any kind, including but not limited to homes, time shares, land, leases, tenancies, vacancies, and the like. (hereinafter, Real Property) Purchaser further agrees not to use said sign for any prohibited, actionable, illegal or improper purpose. Purchaser agrees not to modify, alter, disassemble, reassemble into a different design configuration or to otherwise combine any of the printed elements of the sign with any other material, or to hang or use any other sign or material on the sign(s) or use any sign(s) purchased with a telephone number not provided by ONFIRE. The exclusive right to use or display a telephone number, contact name or other words in conjunction with the sign(s) and to attach other signs to the sign(s) belongs to ONFIRE throughout the use of the sign.
3. [APPLICABLE TO PREPRINTED SIGNS ONLY] By initiating a purchase or bid, Purchaser agrees that once posting on eBay ends, all use and rights of use of Purchaser in any preprinted sign will end. Preprinted signs may not be used to advertise or promote another eBay posting or eBay listing. For all preprinted signs, Purchaser will reorder a new sign in the event the item is reposted on eBay.
4. Signs MAY NOT be listed, posted, sold or resold on eBay.
5. By initiating a purchase or bid. Purchaser acknowledges and agrees to the following warning and to abide by all instructions for use: WARNING: SIGNS WHICH ARE SHIPPED TO BE ASSEMBLED MAY CONTAIN PARTS WHICH CONSTITUTE A CHOKING HAZARD. USE ONLY AS INSTRUCTED. PURCHASER ASSUMES ALL RISK ASSOCIATED WITH THE USE, SAFEKEEPING AND ASSEMBLY OF THE SIGNS. KEEP OUT OF THE REACH OF CHILDREN.
6. In the event of a breach or a threatened breach of any covenant in this or the foregoing sections, Purchaser hereby agrees that eBay and ONFIRE do not have an adequate remedy at law, and shall suffer irreparable harm. Therefore, the parties agree that eBay and ONFIRE shall be entitled to obtain in a court of law or equity: (i) a temporary and/or permanent injunction restraining Purchaser from any further breach of such covenant or covenants, an order for return of the sign(s) and damages as may be appropriate. ONFIRE shall have the right to advise eBay of all facts concerning any act in violation of this agreement and eBay and/or ONFIRE shall have the right to take such further action as is warranted. Purchaser also agrees to immediately cease and desist any use of the sign(s) for any prohibited, actionable, illegal or improper purpose upon any demand by eBay or ONFIRE. Purchaser further agrees to hold harmless, indemnify and defend ONFIRE, eBay and any and/or all of their agents, officers, directors, employees, contractors, and transaction assistants from any and all claims, demands, lawsuits, proceedings, actions and losses arising from any use of the signs by Purchaser. Purchaser understands and agrees that eBay is not the seller of the sign(s) and not a party to this agreement, although eBay is a beneficiary of certain protections provided by this agreement.
7. By initiating a purchase or bid, Purchaser accepts the foregoing and confirms that Purchaser is purchasing the signs to advertise Purchaser's Real Property FOR SALE BY OWNER.
Use Of Real Estate Signs Broker Purchaser
1. By initiating a purchase or bid, broker purchaser ("Purchaser") covenants and agrees that Purchaser is purchasing the sign(s) for Purchaser's own account for advertising real property and further covenants and agrees that the sign(s) are not for resale or other use. Purchaser specifically agrees and understands that the word "posting" or "as posted on" and/or similar language on the sign(s) references eBay postings online which are sometimes referred to as "eBay listings," and that phrase "eBay listing" is an eBay community online usage only. Purchaser agrees and understands that eBay listings are not listings as that term is or may be defined by real estate law or agency law or other applicable law and that NO BROKERAGE OR AGENCY RELATIONSHIP OF ANY KIND is intended or formed by the sale of the signs, by posting on eBay or by the "eBay listing," or by the other acts of eBay, ONFIRE, or Purchaser.
2. By initiating a purchase or bid, Purchaser agrees to use the sign(s) solely for advertising of Purchaser's client's real property as currently posted on eBay and not for any other use. Real estate advertising includes real estate of any kind, including but not limited to homes, time shares, land, leases, tenancies, vacancies, and the like. (hereinafter, Real Property) Purchaser further agrees not to use said sign for any prohibited, actionable, illegal or improper purpose. Purchaser agrees not to modify, alter, disassemble, reassemble into a different design configuration or to otherwise combine any of the printed elements of the sign with any other material, or to hang the sign from or use any other sign or material on the sign(s) except for Purchaser's brokerage or agency name(s) and contact information or references to open houses or to sales contract status.
3. [APPLICABLE TO PREPRINTED SIGNS ONLY] By initiating a purchase or bid, Purchaser agrees that once posting on eBay ends, all use and rights of use of Purchaser in any preprinted sign will end. Preprinted signs may not be used to advertise or promote another eBay posting or eBay listing. For all preprinted signs, Purchaser will reorder a new sign in the event the item is reposted on eBay.

Purchaser understands and agrees that eBay is not the seller of the sign(s) and not a party to this agreement, although eBay is a beneficiary of certain protections provided by this agreement.
7. By initiating a purchase or bid, Purchaser accepts the foregoing and confirms that Purchaser is purchasing the signs to advertise Purchaser's client's Real Property.
Use Of Non Real Estate Signs By Purchaser
1. By initiating a purchase or bid, Purchaser covenants and agrees that Purchaser is purchasing the sign(s) for Purchaser's own account and further covenants and agrees that the sign(s) are not for resale or other use. Purchaser specifically agrees and understands that the word "listing" or "posting" or "as posted on" or "as listed on" and similar language on the sign(s) refers to eBay listings only, which term is an eBay community online usage. Purchaser agrees and understands that eBay listings are not listings as that term is or may be defined by real estate law or agency law or other applicable law and that NO BROKERAGE OR AGENCY RELATIONSHIP OF ANY KIND is intended or formed by the sale of the signs, by posting on eBay or by the "eBay listing," or by the other acts of eBay, ONFIRE, or Purchaser.
2. By initiating a purchase or bid, Purchaser agrees to use the sign(s) solely for advertising of Purchaser's personal property currently posted on eBay and not for any other use such as advertising real estate of any kind, including but not limited to homes, time shares, land, leases, tenancies, vacancies, and the like. Purchaser further agrees not to use said sign for any prohibited, actionable, illegal or improper purpose. Purchaser agrees not to modify, alter, disassemble, reassemble into a different design configuration or to otherwise combine any of the printed elements of the sign with any other material, or to hang or use any other sign or material on the sign(s) or use any sign(s) purchased with a telephone number not provided by ONFIRE. The exclusive right to use or display a telephone number, contact name or other words in conjunction with the sign(s) and to attach other signs to the sign(s) belongs to ONFIRE thoughout the use of the sign.
3. [APPLICABLE TO PREPRINTED SIGNS ONLY] Preprinted signs (hereinafter, "Preprinted Signs") have an eBay listing number and bidding date printed on them. By initiating a purchase or bid, Purchaser agrees that once posting on eBay ends, all use and rights of use of Purchaser in any preprinted sign will end. Preprinted Signs may not be used to advertise or promote another eBay posting or listing. For all preprinted signs, Purchaser will reorder a new sign in the event the item is reposted on eBay. Signs that are not Preprinted Signs may be reused to advertise other eBay personal property listings, as long as such use conforms to all of the other terms of this agreement.
