General Terms & Conditions

Unless we state otherwise on a particular eBay auction page, all of Sunroom Treasure’s eBay auctions are subject to the following general terms and conditions. PLEASE DO NOT BID on any of our items without first reading these terms and conditions, as once you have placed a bid or purchased an item you will be bound by them.

Condition; Item Description.

We have done our best to reveal the material condition of the offered piece in sufficient detail. We are not experts in this type of merchandise; accordingly, if any item is not “as described” in our auction page, your sole recourse is to ask for a refund under our “Return and Refund Policy,” described below. In no event will we be responsible for any defects in condition that are either disclosed in our item description or are clearly depicted in our auction photos. WE DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR INPLIED, REGARDING ANY ITEM SOLD, INCLUDING BUT NOT LIMITIED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Photos

We are not professional photographers. Colors may appear slightly different to each bidder due to monitor settings on your personal computer. For that reason, colors may vary slightly between what you see on your screen and the product you receive. We are not responsible for slight variations in color, and will not accept returns based on this except in extraordinary circumstances where it can be clearly proven that the discrepancy was our fault.

Return and Refund Policy

If you feel an item has been incorrectly described on our auction page, please email us within two 2 calendar days after the receipt of the item and explain why you feel that way. If we agree, you will return the item to us in exactly the condition it was in when we delivered it to a “common carrier,” including all original tags and packaging. When we receive the item back from you, we will refund your winning bid or purchase amount, sales tax, shipping and handling charges, promptly but in no event later than 7 business days after we receive the item. If any item is returned to us in a condition different from the condition it was in when we delivered it to the “common carrier,” or if we believe in good faith that the item returned is not the same as the item we shipped to you, we will notify you and return the item to you without a refund.

Except for the above return and refund policy, ALL SALES ARE FINAL. Requests for returns or refunds made after the two (2) days following receipt of the item will be honored only in our sole discretion based on compelling evidence that we were at fault.

Payment

In accordance with eBay's changes in October of 2008, PayPal is our accepted method of payment. 

Shipping, Handling & Insurance Charges

The winning bidder or buyer will pay a “shipping, handling and insurance charge” which will be stated in each auction which is based on size, weight, protective packaging, value of the item, delivery confirmation and careful handling which complies with all eBay policies.

Shipping Schedule

We typically ship 4 to 5 times a week Monday thru Friday. We do not ship on the weekends. All overnight packages will go out within 1 business day of receipt of cleared payment.

Insurance

Insurance is included in the price of “shipping, handling and insurance charge”.

Note to International Overseas (non-US) Buyers

Your purchase may be subject to Value-Added Tax (VST), General Sales Tax (GST), customs duties and other taxes, payments and impositions required by the law of your country. Please consult with your accountant or tax advisor before bidding in any of our auctions or purchasing any items from our store or fixed price items. The laws of your country may prohibit you form buying or importing our items; be sure to check with your attorney before bidding on any item that may be illegal in your country. We are not a “commercial vendor” in any country other than the United States of America, and are accordingly not obligated to comply with any laws, rules, license requirements, or regulations in your country unless we are advised otherwise by our legal counsel. All payments must be made in U.S. Dollars and we will not accept any other currency. The U.N. Convention on Contracts for the International Sale of Goods shall not apply to any of our auctions or sales. We list full purchase price on shipping documents and do not list items as gifts.

Restricted Bidders or Buyers

We will not honor bids from eBay members with a feedback rating of less than -1 or a feedback rating that is less than 98% positive. We will reject bids from any person who was a “non-paying buyer” (see below) in any of our previous auctions or purchases from our store or fixed priced listings. If you fall into any of these categories, please do not bid on any of our items.

Bid Retractions

Once you have placed a bid in one of our auctions, “your bid is a legal contract” and you may not retract it for any reason without our permission, which we may withhold in our sole discretion. Please DO NOT BID until you have all of the information you need about an item; if you have already bid on an item before requesting additional information, you will not be allowed to retract your bid based on the additional information we provide you.

Nonpaying Buyers

We do not tolerate nonpaying buyers (NPBs). If you are the winning bidder and you fail to contact us within 4 days after your purchase or if you fail to tender all funds due to us within 7 days after your purchase, we will assume you are a non-paying buyer, your purchase will be canceled and you will receive a nonpaying buyer strike and you will be barred from purchasing from us again.

If you are planning on going on an extended vacation or business trip when the auction closes and will not be able to communicate with us within the above time periods, please contact us in advance and let us know so that we do not mistakenly treat you as a nonpaying buyer.

Auction Termination

We reserve the right to terminate any auction prior to the closing date for any reason. In that event we will notify each bidder, and let them know whether and when the item will be reposted. If an auction ends at any time during any eBay outage (regardless of eBay policy or classification), the auction may be cancelled and the item reposted at a later time. In that event we will use our best efforts to notify all bidders via email of the new auction posting.

Communications to Seller

All Communications to seller should be transacted thru the eBay contact seller or ask seller question options within eBay. We will not be obligated to respond to any direct email requests outside of eBay. We will use our best efforts to respond to all email communications thru eBay within twenty-four (24) hours of receipt. Any additional information we provide about a particular item may, at our discretion, be posted to our auction page or otherwise made public for the benefit of all bidders.

Disputes

In the event of any dispute involving one of our items, you agree to submit the dispute to eBay’s Square Trade mediation service before leaving “negative” or “neutral” feedback for us on eBay’s Feedback Forum or pursuing any other legal remedy. By bidding on or purchasing any of our items, you irrevocably agree that any dispute, conflict, or controversy between you and Sunroom Treasures will take place only in a court of law located in Carver County, State of Minnesota, United States of America, and will be governed by the laws of the State of Minnesota that apply to contracts between residents of that State.
