INTELLECTUAL PROPERTY RIGHTS: FAQ’s
Q. Why was my auction
suspended?
A. A&E Television Networks
(AETN) submits violations to eBay’s VeRO department on auctions or
listings that infringe on any intellectual property owned by AETN. eBay’s
policy is to then suspend any auction where a violation has been submitted
by a right’s owner. eBay does not prescreen auctions prior to launching
them. Auctions for authorized pre-owned products are permissible in the
eBay marketplace. AETN enforces its intellectual property rights on a
continuous basis to preserve the integrity of its name and its copyrights,
trademarks and logos. Unauthorized sellers often provide lower quality
merchandise which may reflect poorly on AETN .
Q. What is an authorized
product?
A. Authorized products are AETN
videos and DVDs sold directly by AETN or any of its authorized vendors in
the United States for personal use. Terms including "bootleg," "copy" or
"can’t guarantee authenticity" are not authorized. These may include
copies made in other countries that are unauthorized by AETN.
Q. How can I purchase an
authorized product?
A. Authorized
products are sold directly through AETN and several of its networks
including A&E Network®, HistoryTM , History International™,
BioTM, Military History™, History en español™, Crime &
Investigation Network™, A&E HD™, and THC HD™, as well as through
A&E IndieFilms™, AETN International, and AETN Consumer Products and
through authorized vendors in the United States. To view the auctions

Q. How can I get more
information on eBay’s polices for rights owners?
A. For more
information on copyrights see http://pages.ebay.com/help/policies/copyrights.html. For more information on trademarks
see http://pages.ebay.com/help/policies/trademark.html.
Q. Can unauthorized
products be sold if "unauthorized" is stated in the auction?
A. There is
no circumstance where unauthorized products can be sold. All rights are
protected under applicable Copyright and Trademark laws.
Q. Can the AETN
trademarks, artwork or logos be used in the listing?
A. No. The use of
trademarks, logos, trade names, artwork or music owned by AETN may violate
copyright law and/or wrongly imply that your listing is authorized,
sponsored or approved by AETN and it may dilute the value of those
intellectual property rights, in violation of both state and federal law.
The use of trademarks as keywords to drive traffic to your listing may
violate trademark laws as well as eBay’s own policies: http://pages.ebay.com/help/policies/trademark.html.
Q. Can AETN videos or
DVDs be sold on eBay in the United States?
A. Only if they are
videos or DVDs that were purchased in the United States for personal use
from AETN or any of its authorized US vendors.
Q. Can AETN videos or
DVDs released outside the United States be sold on eBay?
A. You cannot sell
AETN videos or DVDs in the United States that were released for sale in
other markets. It is a violation of applicable law to sell in the United
States an AETN product that was released for sale in another market.
Q. Can copies of television shows recorded from a free television broadcast be sold on eBay?
A. No. Selling your
own unauthorized copy of a video or DVD recording from a television
broadcast is not permitted. Only videos or DVDs distributed by AETN or an
authorized distributor in the United States and purchased by consumers can
be sold on eBay.
Q. What about converted
or backup copies?
A. You cannot sell such a copy even if you call it a "backup" or
"converted" copy. You cannot take a video released in PAL format for use
overseas, for example, and make a copy "converted" to NTSC format for
viewing on players commonly available in the United States. Similarly, you
cannot take a DVD released for Zone 6, for example, and make a "converted"
copy for viewing in Zone 1. These are considered pirated
copies.
For more information regarding
pirated videos, see the Motion Picture Association of America About Me
page at http://members.ebay.com/aboutme/mpaa. You can also find more information at http://pages.ebay.com/help/policies/unauthorized-copies.html.
Q. Can movie trailers,
screeners or other promotional items be auctioned?
A. No. Items used to
promote television shows or movies including commercials, trailers,
screeners, medial kits, etc are manufactured and distributed to partners
of AETN for promotional purposes in a limited time period. The promotional
partner is not permitted to sell or dispose of these items. These items
are not intended for consumers and may infringe on owners’ rights. You can
find more information about promotional items at http://pages.ebay.com/help/community/png-promotional.html.
