Intellectual Property Information
We refer to the above matter and confirm that we act for Mr George.
Mr George is a provider of search engine optimisation (SEO) services and owner and creator of the SEO package sold through online sources such as ebay. The product that Mr George has created does not breach the known intellectual property rights of any entity.
On previous occasions, a practice has been adopted amongst some competitors to list Mr George's products, sales and advertisements via the VeRO program with ebay. As noted above, Mr George's product does not breach any known intellectual property rights of any entity. Accordingly any listing via the VeRO program involves the making of false, misleading and deceptive statements. We further note that a statutory declaration must be completed with any listing via the VeRO program. Making a false or deliberately misleading statement in a statutory declaration is a criminal offence in all States and the maximum penalty carries a prison sentence.
We note that the listing of Mr George's products on the VeRO program has the potential to cause Mr George significant loss and damage. In the event that Mr George's products are falsely listed under the VeRO program or some other similar program, we have general instructions to commence proceedings immediately seeking injunctive relief requiring the listing to be removed, damages, exemplary damages, equitable damages, equitable compensation and costs. We further note that we have instructions to refer any suspected criminal behavior i.e. the swearing of a false statutory declaration to the relevant policing body.
